CCTV on a Semi D

    My friend is having some issues with her neighbour. There has been property damage caused, can't really go into detail.

    She would like to get CCTV to hopefully stop this happening in future and if it does, capture it.

    The question is, if the camera is facing into the garden and has visibility of the neighbour's garden are there any legal implications?

    I know that CCTV is getting more and more popular for crime prevention, so anybody's experience or knowledge is appreciated.

    Is the neighbours garden visible from the street or from your friends garden ? if so then you are breaking no laws.

    Not sure on the legalities around it but probably best practice not to capture your neighbours property on your CCTV.

    It's likely to inflame any tension

    Cheers, no the houses have side gates, but back onto the gardens of the next row of houses.

    Thanks, understand it's a difficult situation alright.

    I suppose the question should be, If the camera is aimed at her property but has visibility of a small portion of the neighbours garden, is this acceptable?

    I got this from the dataprotection.ie site. I read it as there could/might be issues.

    Domestic use of CCTV systems.

    The processing of personal data kept by an individual and concerned solely with the management of his/her personal, family or household affairs or kept by an individual for recreational purposes is exempt from the provisions of the Acts. This exemption would generally apply to the use of CCTVs in a domestic environment. However, the exemption may not apply if the occupant works from home. [ Where the exemption does apply, a person who objects to the use of a CCTV system - for example, a neighbour who objects to images of her/his property being recorded - may be able to take a civil legal action based on the Constitutional and Common Law right to privacy.] It should be noted that recording of a public space, even partially, or when recording is directed outwards from the private setting, it may not be regarded as a ‘personal or household’ activity for the purposes of the Data Protection Acts, and this may have immediate and particular interest to drone operators and data controllers.

    What if you partially covered the camera lens with a bit of tape, so the neighbours property is not captured?

    We have cctv on a semi D while the front yard is ok because it’s visible from the public road the back garden is a different matter and while we were installing our cameras a portion of our neighbors back would have been visible from our side and back camera..the installer got us to ask neighbors if this was ok if not he could tape up the camera to block out next door..
    Our neighbors were fine with it and happy enough it was covering some of their house..

    Thanks for the advice and experience lads. I'll get her to speak to the installer. The neighbour on the other hand is a different story!
