Hertz - people carrier - cat B licence

    Sorry if this is the wrong forum to ask, please move ass appropriate. I have called hertz but can't get through.

    I need to rent a people carrier for 9 people (10 if you include me as the driver). I can rent this from hertz or another rental company but my question is around my License. I have a cat B and it shows I can only have max 8 passengers. I presume this would not cover a people carrier / transporter van/bus?

    Cat B is 8 passengers plus driver, so 9 in total.

    Far as I know the biggest hertz do is 9 seater (they will have this down as 9 passengers, but it's 9 in total they mean)

    The limit is for the number of passengers the vehicle is capable of transporting. If it’s 9 passengers plus driver then you are not licensed at all!

    It's not a matter with the rental companies, it's a matter with the rules of the road - in the EU, the maximum for the Cat.B license is 8+the driver.

    Category B licence 1 (Driver) + 8
    Category D1 Licence 1 + 16
    Category D Licence unlimited.

    Driver CPC + Digi card required if driving the bold parts professionally.

    I'd be very surprised if there was even one 10 seater (9+1) vehicle registered in this country.
    So for OP it's not his licence which is the biggest problem, but finding such vehicle.

    Plenty of small minibuses that have that amount of seats, but they need D1 to drive.

    The rental company doesn't give a monkeys how many people you cram in a car. The Gardai and the district court Judge on the other hand kind of frown upon driving without a licence and insurance and you'll get stung for no seatbelt as well if the passenger not wearing a belt is not of driving age.

    Sorry, I actually quoted passenger numbers, so by 9 seater I meant 9 passengers + driver.

    Same as others I listed 16 seater would be 16 passengers + driver and similar with 14 and 12.

    The rental company doesn't give a monkeys how many people you cram in a car. The Gardai and the district court Judge on the other hand kind of frown upon driving without a licence and insurance and you'll get stung for no seatbelt as well if the passenger not wearing a belt is not of driving age.

    I personally doubt you could be done for driving without licence if you packed 10 people is a vehicle with 9 seats.
    You could be done for driving overloaded vehicle, and carrying passengers without seats/belts, but licence applies to type of vehicle, so vehicle with 9 seats doesn't miraculosly become 10 seats for licence purposes if you pack 10 people in it.
    Same with insurance - I can't believe they could cancel the policy for doing so.

    No, that's incorrect in this context.
    Even according to you link, category B licence entitles you to drive vehicle designed and constructed for the carriage of no more than eight passengers.

    If you pack up 10 people into 8+1 vehicle, it doesn't mean you are driving unlicenced.
    You are still licenced to drive it as it is a vehicle designed and constructed to carry 8 passengers.
    Fact that you carry 9 passengers + driver in such vehicle, mean you are breaking the law by overloading vehicle (carrying more passengers that allowed), but it doesn't mean you are driving unlicenced.

    I’d agree with CiniO on this one re the categorisation of the offence. If Hertz did have vehicles requiring a D licence I would expect their systems toprompt for the licence check as their insurance will certainly require an appropriately licensed driver.
