Planning permission refused

    Hi Guys,

    As the title suggests we've (my fiance and I) recently had a planning application for a dwelling refused.

    The only reason for refusal was:
    1) that the proposed development would endanger public safety by reason of traffic hazard, by virtue of the fact that it would result in the intensification of an existing direct access to a national road, creating an adverse impact on that national road where the maximum permitted speed limit applies and thus would endanger public safety by reason of traffic hazard and obstruction of road users due to the movement of the extra traffic generated. The proposed development would therefore be contrary to the proper planning and sustainable development of the area.

    We were previously asked for Further Information on the front elevation and the septic tank which we responded to, and the response must have being satisfactory. The above reason for refusal was never mentioned until the refusal letter came in the post which is very frustrating.

    A little about our situation:
    The proposed house is on family land adjacent to my parents house where they have lived since the early 80's, it's where I grew up and lived the majority of my life (although haven't lived there for about 3 years).
    There wasn't any objections to the proposed dwelling.

    Has anyone had this reason for refusal from the planning authorities before and managed to get a positive outcome from either an appeal or a new planning application??

    Any help is greatly appreciated.

    No particular experience this area, so don't pay too much attention to my ideas...however, from reading your post, it sounds like you proposed to share an entrance with your parents?
    Is there any possibility you could include an "off/on road" parallel to the main road (taking a bit ff the garden) so that you can speed up or slow down away from the main road? Might lessen the impact to traffic on the national road?

    Very little chance of a successful outcome I'd say.

    It sounds like you proposed to use your parent's entrance as a way of avoiding looking for permission to put a new entrance onto a National Primary/Secondary Route. The council have determined that even though you are using this entrance you are adding an additional traffic hazard to the road.

    Does any of the family land have frontage onto a local or regional road? - you might have more success there. Maybe your engineer could organise a meeting with the council roads engineer for the area - as there is a good chance it was on his advice that the permission was refused. Have you downloaded a copy of the planner's report - what does it say about the issue?

    Dardania - you're right we were proposing to share the entrance with my parents - we done this on the advice of the architect. We prob could do an off/on road as you suggested as there is frontage parallel to the road but I don't know if the Co Co would go for it? Certainly one to investigate further though, thanks

    Metric Tensor - unfortunately all the frontage is on the national road. Good suggestion re meeting the council roads engineer, will look into this further. We're in the process of getting the planner's report and notes, can report back with the findings today hopefully
