Pulled in a few hours ago by some Garda. Claimed I sped past him going through a village while him and two others were sat in the car at the side of the road, no gun or anything out. Followed me and pulled me, my speed was his only issue, which I’m sure I wasn’t speeding, maybe a 10% over limit max. However, o asked him for proof of my speeding due to this being he only reason for the ticket and he said “ my opinion is enough”. I’m very annoyed about this, convinced I’m only being pulled due to being a younger driver in a slightly modified car. Gave me an 80 Euro fine and 2 points. If I went to court what are my chances of this being over ruled?

Courts tend to believe professional witnesses and/or those with good records. You against one garda, you would have a poor chance. You against 3 gardaí, possibly very poor.

It's 3 penalty points for speeding most everything now is 3 points. You sure it was speeding , they could do you for dangerous driving with just a visual. Get rid of slightly modified car or make the car plain as possible. You just become a target with any car that stands out as a cheap boy racer look and they'll treat you like an asshole whether it's deserved or not

Guards eyes aren't calibrated like radar guns to detect speed that's why they have calibrated equipment it takes care of the what ifs.

So, you WERE speeding. 10% over the limit is still over the limit.

3 points and €80 fine, or take your chance in court with a risk of 5 points and a much larger fine.

Courts tend to agree with a Garda.

If its a civic with a rear bumper missing I see going around you be lucky that's all you got.

What exactly have you been done for though???

    What's on the penalty notice.

Driving without reasonable consideration is an offence under section 51a of the road traffic act.

    Careless driving is section 52.

    Dangerous driving is section 53.

I was convicted myself of careless in 2006, reduced on appeal from section 53.

    OP,

Challenging or getting smart with the Gardai done you absolutely no favours whatsoever.

Had you taken a different approach you may have just gotten a ticking off!

As punisher said about the type of car, was it modified?

Going around where? I've read it back 3 times and I only see 'village'.

It’s very common to see cars such as Honda Civic’s that are modified to be driving around with no front bumper and in some other cases a back bumper.

Yeah but he was talking about one specific car. Given that there could be 300km between him and the OP it's a very strange question to ask. I'm just wondering was it another thread hunting exercise.

No was just an observation of what the now mods seem to be for what looks very strange.

I've seen a guy going around with huge exhaust dragging along, no bumper, stuff stuck all over it and his driving skills are extremely poor along with doing wheel spins or mini burn outs in traffic.
