Data Protection, deceased relatives, and "goodwill"

    My question is somewhat related to another recent thread with someone looking for records of a deceased relative. Apparently there is discretion for records to be released under "reasons of goodwill". This is from the FAQ of the data protection commissioner:
    There is no right to access/amend the information of deceased persons. A particular data controller, for reasons of goodwill, may choose upon request to supply data relating to a deceased person to a relative.
    Does anybody have any ideas as to what circumstances might trigger the release? I can't find any other details.
    For example, would emotional distress on the part of the relative be a factor?

    Because there is no legal right to get access, the discretion is sole discretion and no particular guidance applies.
