Claim Aghainst Nightclub

    I'm a recent, infrequent socialite in Dublin. I was on a night out recently, and I wanted to get a takeaway and after having paid I was kicked out (for no proper reason). I had already paid and had no reason to get kicked out, and I'm wondering if I'm best to bring the small claims procedure or sue under district court rules. All feedback appreciated. I stress I am not looking for advice, just for what people consider the appropriate response as I was wronged in this scenario.

    You’d need proof you had paid, and proof you were unfairly ejected before getting your goods.

    I fully expect this will come to nothing and you need to build a bridge.

    Nightclubs do food????

    Were you drunk and causing a nuisance.

    If not request under freedom of information any electronic data they hold on you at a given time on CCTV.

    Its up to you then to prove you acted accordingly.

    You're best sobering up and getting on with it. Are you actually going to stand up in court in a dispute over the price of a batter sausage and chips?? You'd spend more in bus fare getting in and out of the court.

    Rob : What about curry chip post haste are you not understanding
    Bartender: Security please show this man to the nearest supermacs .
    Rob : I will have my curry chip in this life or the next ! Expect correspondence from my Lawyer .

    I guess "proper" is subjective. You were removed from a nightclub/takeaway for some reason, you may not agree with that reason, but that's another story. Do you have any sober witnesses? Intoxicated witnesses may not be very helpful.

    How much did you spend on your food? It's not right to lose your money, but I would think really hard about how you behaved on the premises. Going to court is probably the last step you should be taking. Have a chat with the a manager first, if that doesn't work out and it's a chain, then contact their HQ. Go through social media, but again, that could all back fire depending on your behavior and what CCTV shows ;)

    OP: Well I am very annoyed I want to know what my rights are or what I can do. Can I take a claim against the chipper for the embarrassment and the loss of my €7.99.

    The cost of the small claims court is not recoverable and you can't build it into costs.

    It is probably more than than the cost of a takeaway.

    Can a mod just close this please? As if the time of post wasn't clear enough I was not sober when I posted this.

    For anyone still curious I was waiting for food, standing beside the wall when I was pulled out as a crowd was developing. I got punched in the stomach by the bouncer and wasn't allowed get my food or tell my friend that I had been kicked out. I was annoyed at the time, I'm over it and wouldn't have posted this sober, needless to say.
