Can this be considered fraud?

    Hypothetical situation from something I thought about.

    For the sake of argument say our country passes abortion.

    A man gets a woman pregnant from a one night stand, he wants to keep baby but she doesnt, advises him she will be having an abortion and then says she had it. All what she has "advised" is able to be confirmed through messages etc
    They go their separate ways.

    Fast forward any number of years 3,5,8 whatever and she actually hasn't had the abortion and had intentionally lied to this man as she never planned to have it. She then takes him to court for maintenance of the child over the years.

    Can this man have an argument that his was decived and this is an attempt at fraud and could possible sue her(if he can prove this was her intention all along) Would he have a case or argument that past arrears would not be valid based on the deception by this woman.

    Id just like to know how people think it would pan out as I can't find any local or European cases similar

    Maintenance is only awarded from the time of the application and even in cases of arrears they on nly go back 6 months so he can't be landed with a huge bill for many years.

    Not sure why you think he could sue her? You can't hold someone to having an abortion just because they said they would.
