Intellectual Property

    Hi all

I have recently joined a new company and my employment contract has quite stringent (but probably typical) clauses regarding intellectual property.

I have an idea which has totally been developed outside of my working hours so don't see why my employer would be due any benefit as a result of my idea.

So the question I have is whether I could enter into an agreement with someone else who would front up the development and (hopefully) realisation of the idea and that I could have an agreement with this person to yield a % benefit (to be mutually agreed) but would remain faceless.

I've looked up silent partner etc. but it's not what I'm looking for.

Essentially I want to yield the benefit of the idea/invention but not run the risk of my employer looking to take a cut.

I would need to collaborate with at least 2 others to make the idea work in any case so would have to share some of the benefit regardless.

I hope you know what I'm talking about and know of a mechanism.

    Thanks,

    D

You have an employment contract which contains stringent clauses dealing with intellectual property. You need advice on whether your contract of employment could impinge upon your ownership of, or dealings with intellectual property arising out of work that you carry out, outside of work hours.

If you rely upon the wrong advice, there could be serious implications for you, financially or otherwise.

Furthermore, this thread contains a request for legal advice, which is not allowed by boards.ie.

Therefore, this thread will have to be closed.

    You need professional legal advice.
