Speed van

    I was driving yesterday and I went through a speed trap when I saw it I braked hard but I was on top off it before I knew it I looked at the speedo I was doing around 60 km but I think I could be caught for around 100km in a 50 km speed limit I don't speed totally forgot myself pure stupidity on my part and dangerous will I get much pently point because I was going so fast and what about insurance any help please thanks

    Most motor insurers don't punish you for your first 3 penalty points. It's only if you do it again that they'll penalise you.

    No, speeding carries a penalty of 3 penalty points!

    Speed vans don't do for dangerous/ careless driving. That must be witnessed by another person or Garda

    Is that a fact?

    Does that mean someone can be caught by speed can doing 150km/h in 30km/h zone by the schools where children run around, and still be only fined 80 quid and 3 penalty points?

    Not from a speedvan. All they can do is issue a fixed penalty.

    In theory a dangerous driving charge could arise from a speed van detection, I'm not sure of it happening here, but it would have to be alleged before and in fact in lieu of any FCPN for speeding or double jeopardy could arise. Problem is (in the case of GoSafe) that detections lead to an automatic issue of a FCPN, but with a Garda van it could happen.

    I could see a more substantial charge if it was witnessed by a member of AGS.

    I don't think Go Safe would be in a position to bring a prosecution for DD or CD as they would have to report the matter to the Gardai.

    I believe there are court rulings that speeding on it's own does not constitute careless or dangerous driving.

    No GoSafe could not bring such (unless they like anyone can attempted a private prosecution and didn't issue the FCPN - but that simply ain't going to happen).

    Speeding in itself can and does sometimes result in a dangerous driving charge depending on what evidence may be available, the speed and surroundings etc - that is to say "driving in a manner which a reasonably prudent man, having regard to all the circumstances, would recognise as involving a direct, immediate and serious risk to the public".

    Often though such are reduced to a charge of driving without reasonable consideration.
