Action against local authority for accident caused by condition of road

    Hi All,  (Edit: should say County not Country)

    is this possible? Ive seen an old thread in regards of a similar issue.
    I dont want to go into any details, but to give you some idea: an accident has been caused due the condition of the road. (multiple accidents at the same spot actually)

    Im willing to take on the long road and collect all evidence/data that i need, just need to see where to start first.

    Realise that it is difficult to sue a council in such circumstance. You might get them for misfeasance (doing this wrong) or malfeasance (deliberately doing it wrong), but can't for non-misfeasance (not doing their job).

    Most solicitors in general practice would act for you, but realise your chances of having to pay their (and the council's) fees is high.

    yes, i would rather pay up a "few quid" for the solicitor than what the damage is.
    The thing is, that it is a fact that the situation has been caused by something that hasn't been properly built/executed. im planning to get reports for that too and gather information in regards of how many accidents occurred at the same spot and what the circumstances were (hoping to prove that the conditions were similar to mine which shows that there is in fact an issue).
    Would the Garda be allowed to provide information like that? (Timeframe and number of accidents-report)

    Assuming that damage less than 15K then limited to DC, amount of costs recoverable from the County of you win are very limited and for such a case would not cover the time and grief involved. Then expect the County if you win to appeal the Circuit Court. So if you have about 10-15K to waste over an above the costs that you will get if you win then go to any solicitor and put him or her in funds to the tune of 20 grand to cover everything and that is the amount if you win add 5 k if you lose.
