On the mortgage but not on the title

    Good morning,



    I have a joint mortgage with my brother, he lives in the property and just pays the mortgage which is considerably below market rent.



    I have forced the sale of the property via my solicitor and it has now come to light that he hasn’t been paying the associated bills e.g. management fees and now there is a sizeable chunk outstanding.


    The property has gone sale agreed and his solicitor is in receipt of the title deeds which show my brother is on the title only while I am on the mortgage jointly with him. Given I am not on the title, is my brother solely responsible for the bills? I am probably clutching at straws but it’s infuriating he hasn’t paid these.

    This is a request for legal advice and that is not allowed by boards.ie.

    You seem surprised that you are not on the title to the property so perhaps there are questions to be asked in that regard.

    You should contact your solicitor in relation to the various issues.
