    Hi.
My wife is moving back to Ireland in July from the UK after been there over a year. she purchased a car in January. We will be applying to VRT to get an exemption on the car as she will have been living and working in the UK over a year and have the car over six months. My question is can the car be transfered over to my name (husband) without a problem straight away?
The car isnt supposed to be sold for 12 months, but as i am her husband, will it be OK?

There is no exemption to the 12 month rule for a transfer to a spouses in the VRT manual

No, you can't transfer it to spouses name. It must stay in the name a person who imported it.

Out of curiosity, why would you like to have it transferred to spouses name?

You might want to verify, taking account of personal and occupational ties, whether her "normal residence" has remained in Ireland all along meaning that she might not qualify to bring in a car VRT free notwithstanding that she has lived abroad for 12 months and owned the car for more than 6 months when she gets back.

If she previously lived here with you and your family (if any) and has been returning here on a regular basis, it may be that her "normal residence" has remained here and that all she has had abroad is a temporary residence. The VRT relief, derived from an EU directive, is based on a person transferring normal residence rather than returning from a temporary posting without cutting ties in the original residence.
