I think what differeniated this and similar cases was the company had explicitly mentioned it reserved the right not to work with material that clashed with its corporate culture which was (AFAIR from reading US Constitutional Law) not covered under 1st amendment expression rights but also did thus not fall under any 14th rights which covers individuals.
