Refund / replace car

    Hello,

    I am hoping someone can help. I bought a used car off an SIMI approved dealer in December 2016. 4 days after buying, it had to be towed to the garage. Basically, the driver side spring surrounding the shock had become detached and jammed into the wheel. No crazy driving was done by me, it happened at a set of traffic lights on the Howth Road.

    Obviously I was bit annoyed but I had a 6 month warranty and was happy to chalk it down as a freak thing and have it fixed. In January however, the hand brake went, again into the garage to have it fixed. March brought a few minor fixes, nothing major to say the car is not roadworthy.

    This morning however strike 3 occurred. I was about to pull out of my driveway, when I released the handbrake and put the car in 1st gear it would not move. So up came the hand brake and I tried to bring the gear stick back into neutral. The gear stick won't budge, it is stuck in 1st. The car even with the handbrake down won't budge, and when I take the foot off of the clutch it goes to cut out. So tomorrow morning it is being towed up to the garage, I spoke with them and explained the situation, they were stumped as was my own mechanic I use when I explained on the phone.

    Now the issue is I am 7 days away from my warranty being out of date. My question for you folk is there anything I can do here, I remember speaking with the CCPC at Christmas post shock going, and they said the car needs to be roadworthy upon purchase. The garage are obliged to repair it and generally after 3 major issues they are obliged to make amends by replacing or refunding.

    Quite clearly I have bought a heap of crap but do I have any come back here at all.

    WHat make of car and what year?

    The two issues you've described so far could be down to wear and tear, and if the clutch is gone that could be the same tbh from what I've read that you've posted.

    Its a bmw 1 series and the year is 09

    I don't think you've much case for a refund/replacement on an 8 year old car that has had two issues that are wear and tear, and potentially a third being the same.

    See what's wrong with it when it goes to the garage and what they say.

    sounds like the garage are being very accommodating. Most warranties on used cars are only engine and gearbox,especially a 8 year old car. The first problem I can see them covering being it was so close to purchase time. I wouldn't consider the handbrake cable to be a major issue, i know its a safety issue but cables to break especially 8 year old ones. The gearbox they should fix as you are still within the warranty time, but I highly doubt they will refund or replace the car.
