    In order to bring Apoca to the small claims court, can the complaint be made against the company, or would it have to be against a named person

    Ie.. John Smith, Apoca, main st, anytown. Etc

    Have lodged an appeal, but I have no faith in their self regulation.

    Against the company but you'll have to ensure you have their correct address

    Anyone here, had previous small claims court experience , that maybe they can provide the correct details needed.

    As I've said.. I have no confidence in their self evalaluated disputes process.

    Small Claims Procedure will not deal with issues relating to clamping.

    You will have to issue proper District Court proceedings. A solicitor would be best to do this properly.

    They will settle long before it sees the inside of a courtroom. They don't want the house of cards to come tumbling down.

    Could be that or the fact it'd cost the company a few grand to go to court with an expensive lawyer where even if they win they are out of pocket. Much cheaper to just give some irritating person that keeps contacting them and then issues proceedings their money back.

    If they were sure of their business model they would have surely at this stage crushed one of these irritating people like an ant?

    What does a company winning ( not losing, in reality. They don't "win")a court case against a punter get them? Nothing. They wouldn't be any better off.
