    Hi Folks,

    Just wondering if anyone can shed any light on the following:

    One of the conditions for a homeowner to claim the HRI on a rental property is that the tenancy is registered with the RTB. If a tenancy is exempt from RTB, can an individual claim the HRI?

    There are numerous instances whereby properties are exempt. For instance, where it is let to the county council to be used for social housing. It would seem a little harsh that a landlord would be denied the HRI for renovating a house to be used for social housing, especially when we consider the current housing shortage.

    Is it simply a case that in the above scenario, the landlord pays the €90 RTB registration (despite the property being exempt) and then proceeds to claim the HRI.

    Are you mixing up the idea of the tenancy being registered with the landlord being registered.
    A social housing tenancy may not need to be registered with the TRB, but I don't think that exempt the landlord from being registered as landlord.

    The specific wording on the HRI scheme from Revenue is as follows:

    "A Landlord’s rental property, which will be occupied by a tenant and registered with the Private Residential Tenancies Board within 6 months of the completion of the works."

    The above seems to imply that the property must be registered with the RTB. However, if the tenancy is exempt from registering for RTB, does that mean the HRI cannot be claimed on that property?

    the property is not exempt, its the tenancy, the landlord must register if in receipt of rent, either directly from a tenant or from Social services.

    If the tenancy is exempt, why is there a need for the landlord to register?

    Am I missing something there? Can't see where it says that landlords have to register for exempt tenancies?
