Eir Broadband Consumer Rights

    Hi,

What are my consumer rights with regard to broadband speeds from Eir?
The speed is 0.32Mb which is terrible.
I have rang repeatedly, had numerous technicians out all to no avail as after months and months there is no improvement and no willingness on Eir's behalf to help the situation..

Is it possible to cancel the contract without having to pay the balance as Eir are not supplying an adequate service?

I have posted a query to Eir. I am unable to insert link as I am a new user. The subject is "Eir Broadband & Consumer Rights" and the boards thread number is 2057719676

The speeds quoted are up to a certain speed.. there is no reference made to a minimum speed..

that could be their get out clause. is the speed recorded by a device hardwired into the modem?

No, I measured the speed using a website speedtest.net

Get a recording of the call where you ordered, if they made any false claims then you can get out.

I suspect you live out over 5km from the exchange, its the expected speed then. They cant fix it, you've gotta move your house closer to get more. Thats called physics.

    What's your location? Rural location?
How far are you from the nearest phone exchange?
What the phone line wiring like in your house/apt?
Are you using the phone line input box or is it split off on another cable to your router? Have a filter on each phone/BB device?
    Wired or wireless connection?
Line stats for SNR and Noise on your Eircom broadband router?

No, I measured the speed using a website speedtest.net

Was this over WiFi or over a ethernet connection? If it was over WiFi then you really need to test over a wired connection.

Also to get a better idea of things you need to perform several tests at varying times over a few days.

Just to clarify, the broadband was setup a number of years ago. The line speed has deteriorated over time to a point where it is now less than 0.5Mb. (I think it was prob about 3-4Mb at best...)

Line stats for SNR and Noise on your Eircom broadband router? - I could not tell you off hand, but the technician who has called has changed the router on one of the visits.
Wired or wireless connection? - Line speed is less than 0.5Mb, regardless of wired or wireless.
Are you using the phone line input box or is it split off on another cable to your router? Have a filter on each phone/BB device?
There are splitters there but I have also connected wire directly without splitter with no improvement. Eir mentioned this also but this was demonstrated to them that without splitter there is no improvement.
What the phone line wiring like in your house/apt? - Fine, as I said, I have connected it directly to laptop from wire that comes into house to eliminate splitters, poor line, length of cable etc
How far are you from the nearest phone exchange? - No idea, but the house is in the same place as it was when we initially got the broadband and it was not that bad...
What's your location? Rural location? - Yes
Was this over WiFi or over a ethernet connection? If it was over WiFi then you really need to test over a wired connection. - Wired directly and wireless - speeds are equally poor.
Also to get a better idea of things you need to perform several tests at varying times over a few days. - Ha, I have been using it for months and it is equally rubbish during the day, night, weekends....

They have to provide you dial up and a phone line, no more, no less.

Long rotten DSL lines are no use. Have the techs out three times and they'll let you cancel. Then get midband of some sort.

Is that stated on their website somewhere? the MiL is paying daft money for a diabollically bad broadband connection (I've never clocked it at more than 0.5MB, generally far less) and it would be good to have a getout.

Nope, just what their cancellations teams will go by.
