Illness Benefit declined - JS benefit?

    Hi, I have been on IB for 14 mths and have sent in another medical report from doc and medical questionnaire from myself...
    I was told by a mate that if I am refused IB that I can make an appeal and get Job Seekers Benefit (i have enough stamps for this apparently) - is this correct? Even though my doc has said that i am definitely not fit to return to work?

    No this isnt correct.

    To be entitled to jobseekers yuo have to be available for and actively seeking fuul time employment.

    If you are likely to be long term out of work due to illness you need to look into disability or invalididy payments.

    Also illness ben only lasts a max of two years paid now, happened to me almost 4 years ago my payment was cut and I am still unable to work.

    To be entitled to jobseekers yuo have to be available for and actively seeking fuul time employment.

    If you are likely to be long term out of work due to illness you need to look into disability or invalididy payments.

    Also illness ben only lasts a max of two years paid now, happened to me almost 4 years ago my payment was cut and I am still unable to work.

    hi there thanks for the reply.. so what happens if my illness benefit is not continued? apparently I have to appeal - but I was told that I should apply for job seekers then?
    Surely I am not left with nothing as I await for the appeal?

    You will have to speak to your CWO about an SWA as soon as possible. So it will be Monday now at the earliest.

    You might be in a position to apply for disability allowance which is a means tested payment or if you have more than 5 years contributions /stamps from employment you may be in a position to apply for invalidity pension. Or if you're in a relationship whereby your partner works at least 20 hours a week FIS may be an option (need to have at least 1 child). Have a look at the welfare.ie website or call into your local citizens information centre.

    Unfortunately he's been told that as far as DSP are concerned he's well enough to return to work so those 2 payments are not relevant right now.

    After 2 years of being too ill/injured to work you should be applying for DA or IP.

    Absolutely wrong. Not in the case of an appeal.

    Jobseeker's Benefit or Allowance Payable Pending Illness Benefit Appeal

    Where a customer has been disallowed Illness Benefit because they have been found "capable of work" (in other words their present state of health would not prevent them from resuming or taking up work) following an assessment by a Medical Assessor, it may be accepted that they fulfil the condition of being capable of work - notwithstanding any statement by the customer that they do not consider themselves to be capable of work.

    This is so, even if the decision of the Medical Assessor is under appeal. The customer is entitled to apply for Jobseeker's Benefit or Allowance if they are not resuming employment even if they are appealing against disallowance of Illness Benefit. While the appeal is ongoing they should continue to send in medical certificates of incapacity for as long as their doctor considers them incapable of work through illness.

    PS infogiver - I have not been declined illness benefit - I am just thinking a head in case it is discontinues..
