Change of terms after deposit paid

    I went to a car dealer today to see a car I wanted and agreed to buy it. When I came back to the dealer (I had lunch to think it over) he was away and I gave him my details and card details to pay the deposit. After I'd gave him those he said he'd service the car and it should be available next week.

    This was after me saying I was looking to buy the car for Monday as its one of the few days I have off and wouldn't be able to pick it up for 2 weeks otherwise and it was the first time mentioned servicing.

    My question is as I'd signed nothing regarding the sale is it ok to pull out of it as information wasn't disclosed till after the deposit details were given.

    So you don't want the free service? And will pull out of the deal because of that?

    Maybe give him a ring and tell him you can only collect Monday and he might be able to arrange to have it serviced for you in the next few weeks.

    The problem is I live on the other side of the country, also nothing was said about it being free. And I get the feeling it won't be.

    Did you ask him if he could bring the service forward and have it ready for you Monday?

    Normally if it's a SIMI place you sign a documents confirming purchase and this outlines deposit, amount owed and terms etc. Was it a SIMI place? Last car I purchased was a non SIMI place but I signed a sales doc outlining money owed etc.

    The service is nearly always included, and is free in all but the weirdest of circumstances. He would probably be happy to not service the car if you ask him to, but they usually do so that your not coming back in the 3 months with silly issues due to not serviced like oil and water.
    Cars are serviced after purchase so they are not servicing cars left on the lot for alot of time.

    Again, if you dont want it, i say they would be ok with it, but if you can, you get more value for money.

    I'd said that after and he wasn't happy to sell it without it. The problem isn't the service it's just I specifically needed a car for next week. I live in quite a rural area so coming to pick it up isn't feasible often and I'd said that.

    Ring him again and sort it out.

    The dealer seems like an honest guy in fairness. He's not willing to let the car go unless he's happy with it.

    Any dealer will be happy to meet you out of hours to collect a car your buying.

    Surely someone could drive you up to collect the car even its a two or three hour spin. Heck even take a half day off work and use public transport.

    Your making a mountain out of a moehill really.

    I suspect you're inventing a problem that doesn't actually exist.

    I don't think it's unreasonable that when you say you wanna pick up a car on a specific day and the guy says yeah then when you pay the deposit it's changed. Otherwise the car is gonna be sitting there till the last weekend in march.

    Everyones missing something here!

    If OP pulls out of the deal he definitely won't have a car for next weekend!

    Any reputable car dealer will service/health check a car after purchase.

    If OP cancels the sale and goes to another reputable garage he'll be in the same situation with a much tighter time frame!

    Come on, we're all big boys here ask dealer to service car sooner or to include a hire car until his is ready!

    Out of curiosity, what car is it?

    OP, if you're having this hassle just buying a car at the other side of the country, how are you going to get the car to the dealer if he has to fix something under warranty?

    I'm stubborn not unreasonable, not gonna ask the man to drive for 6 hours out to me. He was aware of the timeframe I shouldn't have to coax money into his pocket.

    It's a 161 the manufacturers warranty is still in effect.

    Fair enough. Ring the dealer back, explain your circumstances and that if the car cannot be available when you need it then unfortunately it's a deal breaker for you. See if they can accommodate you.
