    Howdy,

I'm a private person looking to purchase used equipment from a VAT registered company in Belgium.

Is VAT payable in this case? The seller seems certain it is but I thought VAT was only paid once, which he would have when he bought the equipment originally.

    Many thanks

You thought wrong the vendor should charge you VAT.

Sorry to thread hijack, if the purchaser in this case was irish vat registered would the Belgian seller be able to not charge vat or if he had to charge vat could the irish vat registered business claim back this vat in any way?

If the Irish party was VAT registered and provided the VAT Reg number to the Belgian party, the Belgian seller should not charge VAT.  The Irish trader would account for the VAT on the reverse charge basis. They would charge themselves Irish VAT on sales (T1) and if they were engaged in fully vatable activities, they could claim a simultaneous input credit (T2).
