Need to leave job

    I am hoping to get some information about leaving my job.

    I used to love my job but recently the owners of the business have decided to take more interest in this side of the business as the other side finished up. I thought great it would mean less office work and more hands on work which I like more and two extra workers. I had worked with them for short burst previous and of course they checked on us on regular basis and we always got on and I felt respected and my opinion mattered. I was always paid on time and took back any owed hours had my holidays etc.

    Since they have started working with me ( there is another employee in the same position as me) alot of things have changed Such as

    -I am never paid on time I could go two weeks with out being paid.

    -They always find an excuse for me not to take holidays or days off. I had to go into work 2 days after getting my wisdom teeth out even though I had a cert for 7 days.

    - I never finish work on time anymore. if I am to finish at 5 they are still giving me jobs to do at 5.45 and these job are not urgent. I never get the extra hours back

    - lastly its the abuse. I am shouted at and cursed at all the time, including in front of clients. I feel intimidated as it is a gentleman far bigger and older then me doing all the shouting. Nothing I do anymore is good enough.

    I hate my job now and I feel I just have to leave. I don't sleep or eat on days I am working as I am so stressed. On my days off all I do sleep as I am so exhausted. I have said all the above to the but nothing has been done to fix anything

    I have been in contact with citizen info and I was told I would have to wait 9 weeks before I get any social welfare she also mention sick benefit. I am looking for a job at the moment but I dont think I can wait till I find one.

    My questions are

    If I left my job tomorrow would the social welfare even consider me for job seekers with the reasons i have said above?

    How long do I stay on sick benefit before I can go on jobseekers?

    If I was to apply for a new job would my new employer need to know that I left my previous job due to sickness.?

    Horrible position to be in. I feel for you.

    First off document everything. How often you work unpaid overtime, when they were late paying you, any form of abuse etc. Put it all down and keep with you.

    It sounds to me like the business could be in trouble, unpaid wages is a sign of cash flow problems. Or they are trying to get rid of you by forcing you to leave.

    You need to (quietly) take a stand and leave at your finishing time. If questioned tell them you have an appointment and that you made it for outside work hours. And leave.
    If you are verbally abused pull them up. Simply state that there is no need to shout, get in your face etc, that you are working on something and will look at what they want when it is completed.

    If it continues I would seek a meeting with an employment solicitor for advice. You may well have a case for constructive dismissal. Social Welfare can actually be very understanding in cases like this especially if you present well and have documented everything.

    Unfortunately jobseekers takes as long as it takes, theres no hurrying it up but you'll get backdated to the date you applied so after the 9 weeks, assuming youre over 25 and youre getting the full 188 a week you should get 1692 in a lump sum and then your standard 188 the following week so if youve got savings could you live off them for the next few weeks until you get your back-payment or get a loan to subsidise yourself for the couple of weeks and pay it back with your back dated money?

    Document everything thats been taking place in your work, thats totally unacceptable how theyre treating you.

    The 9 weeks is not a hard and fast rule, it's up to the particular case worker and with the amount of bullying and the effect it is having on your health they could just put you right on it.

    But that's why the advisor would have mentioned sick benefit, if you take sick leave due to the depression and anxiety caused by your employers actions and then leave, the social is possibly more likely to put you right on.

    But my friend was bullied at work and quit because of it and she went right onto the job seekers once they heard her case with no 9 weeks ago wait.

    as said go out on sick certs and you should get paid ,there is a relieving officer in hanover street that can make emergency payments if you are told you have to wait on a dole payment

    Sounds like you could have a strong case for constructuive dismissal.

    The Workplace Relations Commission could probably provide objective and expert advice (not sure if NERA ...National Employment Rights Agency are now part of that one organisation).

    No one shoiuld have to tolerate those kind of working conditions in this day and age...don't suffer in silence...seek some independent advice about what exactly your rights are.

    The nine weeks referred to is if you voluntarily leave your job social welfare can refuse to pay you for the first nine weeks so they may not get any payment for those weeks, and if that is the case there will be no back pay.
    Op this is not a hard and fast rule and is judged on a case by case basis so you may be entitled to go straight on jobseekers benefit.
