Company have lost change of contract

    Hi,

    Just a quick made up scenario

    "A colleague of mine has been with our company a few years and during that time interviewed and got a new job in a new department a few years ago.

    The terms of his contract stayed the same but his job title and duties changed and he got a letter signed by his manager and HR representative confirming this.

    Fast forward a few years and the company he worked for are an outsource company and the contracts for these employees have switch to new vendors,this new vendor does not have or lost the copy of the change of contract however have his original contract. He unfortunately can't locate his copy either

    They are trying to move him back to orignally role as they say without proof he is supposed to be there they can do this based on his orignally contract."

    Does this scenario seem acceptable as no copy of the change currently exists and an older contract is there or has the fact this person.has been working they're in the new department years mean anything? For sake of argument his not a member of a union.

    This seems like the exact same scenario you've been posting about for the last year. You've just changed it to say you're not in a union.

    If neither he or the company can find a copy then I'd say it never happened.
