An Bord Pleannala -overlooking

    Sorry rant warning ahead:

    An Bord Pleannala have just overturned a county council ruling and permitted neighbours to build up, despite the fact that this would give them direct overlooking opportunities into our home and back garden (suburbia). They currently do not overlook.

    I don't get it. Why are there guidelines on proper planning when these don't seem to be adhered to?

    At least you now know that you'll have no problem building up yourself... one of the disadvantages of living in suburbia is the risk of being overlooked. Could you consider tree planting to obscure?

    Do you mean the letter I received? The reason is that they don't believe this would impact private amenity....

    No. Go on an bord pleanala's website and read the officer's report. It will explain how they arrived at the decision.

    Judicial review high court min €25,000.00. A country for the rich only.

    ABP are a bunch of wasters IMO anyway. It's not them that has to live in the area in these situations

    Situation we had -

    Their case officer that went to the actual area to look at the site etc and completed report for ABP That report recommended refusal (as two other permissions were denied on the site due to traffic danger) yet the wise old boys went and chose to ignore the recommendations of their own report and gave permission. What a joke of a system.

    Exaisle, thanks, they are on a massive slope already. It'll take trees years to block.

    Regretfully, I didn't object to their neighbours' build and they built an overbearing extension which overlooks us shockingly.

    I was told no precedents are set, but maybe this is why they were allowed?

    Gutted.

    As mentioned, type the 6 digit ABP reference number into the search box here: http://www.pleanala.ie/index.htm

    or look here for your particular case: http://www.pleanala.ie/lists/2017/decided/index.htm

    Your case might not be online yet; takes a week or so after the decision. Read the Inspector's report and the Board's direction/order, (which sometimes disagrees with the Inspector's report). You should at least get the reasoning for the decision then.

    Thank you smjm :-), but I've studied their plans. It will be nasty. They even have their living area and kitchen in the new overlooking floor so you can imagine how much privacy we'll have.

    That's crazy. ABP should be outsourced to another country i.e. with no ties to people in this country. Sounds like in your case there was a real agenda from someone. Sorry. That is a joke. In my case their appeal admitted there would be new direct overlooking. Their appeal was so weak and yet it got through!?
