Got caught speeding

    Sorry,had to re-open thread as mod closed it,got caught doing 152km in a 120 zone, didn't mention in last topic but I was pulled over by a squad who took licience and wrote down a share of particulars back in his car,just wondering is it a fine and penalty points regardless or is it case by case.

    depends on what the guard witness .. careless or dangerous driving may be considered depending on other factors . traffic, weather, lane hopping etc..


    If it is just speeding probably just a 80 quid fine and 3 points

    I was on the outside lane on a constant speed, wasn't dangerous.

    As long as you're under 160 km/h, you should be grand. Anything over 160 km/h will get you a ban, which is ridiculous, I know.

    Just from talking to different people ,they all seem to have a different answer as to what I will receive,if I could get a definitive I would appreciate it.

    wasn't dangerous.

    unfortunately the Guard mayhave taken a different view taking all other factors in to account. 152 is touching 95mph ... just shy of the magical 100mph.

    You'll have to wait for the postman to find out what the Guard reckons and take it from there .. but at a min it will be 3 point and 80 quid

    Travelling at 152km/hr isn't dangerous until someone doing 80km/hr pulls out in front of you to overtake... or you get a blow out or something runs across your path.

    It's not beyond the realms of possibility at all.

    Experienced drivers learn to ALWAYS expect the unexpected. Op took a risk with his own safety and the safety of other road users. Which he is free to do. But he can have few complaints when caught for it. I've been caught several times myself and accepted it.

    If only this was the case.

    You see plodders pulling out ALL the time at slip roads or because they've found another plodder, usually about a mile in front of them doing 1KPH less than they are.

    The reason people are mentioning dangerous driving btw:

    Dangerous driving.


    53.— (1) A person shall not drive a vehicle in a public place in a manner (including speed) which having regard to all the circumstances of the case (including the condition of the vehicle, the nature, condition and use of the place and the amount of traffic which then actually is or might reasonably be expected then to be in it) is or is likely to be dangerous to the public.

    The part in bold was added in the 2011 amendment. I believe to underscore that the section can be used for speed alone, if that speed meets the requirements above. As rightly pointed out by Srameen we've no idea what the Guard witnessed, we've no idea if you were driving a shed or a brand new BMW with great breaks. We can't even ask if you were using correct lane discipline, and don't know what the prevailing conditions were.

    It's a hell of a lot easier for everyone concerned for a FPN (fine + points) to be issued. If the guards do decided to go down the route of dangerous driving (Careless doesn't have the same provisions) make sure you consult a solicitor before making any statement if asked and have them for court. It's fairly unlikely I would imagine but others would have a better idea.

    I don't disagree.

    I was just curious what that particular poster thought in regards to speeding and when it is OK to break traffic laws and when it isn't.

    I wont do over the tonne though. It's a self fulfilling prophecy at this point. People believe it's some sort of magical number so it is. It's madness doing over 100 anyway on Irish motorways, we just don't have the discipline for it.

    I wont do over the tonne though. It's a self fulfilling prophecy at this point. People believe it's some sort of magical number so it is. It's madness doing over 100 anyway on Irish motorways, we just don't have the discipline for it.
