    So basically back at the end of October, bought a car, nice little yoke but since day 1 had a grinding noise when hitting the breaks, grinding soon turned to screeching. During this time brought it down to the garage a total of 5 times and they kept saying it was just dust on the breaks.

    So brought it to another garage,

    Heres a breakdown of what was wrong

    2 x wheel cylinders cracked.
    break pipes leaking -- not to sure what these are called.
    2 x tyres needed replacing.
    engine needed to be completely cleaned out of sediment.
    1x starter coil was longer than all the others.

    But the biggest one of all was the fact that the metal of the hand break was actually no longer attached to the floor. That's going to have to be welded back onto the floor in order for it to be safe and drivable again.

    Went down to the garage and all they kept saying was 6 week engine warranty was all that was given, considering that they were not properly checking the car and the mechanic who looked at it after told me it would of been like that since purchase would I have grounds to peruse the garage in small claims?

    Are they allowed to sell cars that are in that kinda state?

    The onus is really on yourself to make sure you get a mechanic etc to give it a look over first.

    Depending on how much you spent, the small claims court maybe an option.

    Tbh if the car was grinding the very first day you bought it from them you should have gone back immediately for them to fix it. Grinding is never normal.
    2 tyres needed replacing, to be fair that one is on you to check the conditions of the tyres.
    Go back to the dealer and show him the list bar the 2 tyres and ask if they will cover it under good faith or maybe a 50/50 deal.

    The repairs are running up just under €500.


    As another poster said see will the dealer agree a 50/50 deal as a sign of good faith.

    Well imo you need to go back to the garage and ask them to sort it out based on the 2nd mechanics findings. If they refuse then talk to a solicitor.

    The Small Claims court will cost you about 15 euro I believe and when they get the summons they might have second thoughts and pay up.

    Are they an SIMI registered garage?

    If they are then a complaint to SIMI can sometimes make them pay up.

    it would save anyone buying a car a lot of trouble if they had a mechanic look at it first or at least take it for a test drive, which would have shown up brake problems. and check the basics like tyres.
    Sediment in the engine means it's due a service I guess, you could have asked them to service it as part of the deal.

    SIMI helps the garage, not the consumer. If it only costs €500 to fix, go the small claims route, as a solicitor will probably work out costing more.

    I worked in the motor trade for 8 years and to keep SIMI membership garages have to follow a code.

    A letter from SIMI meant the consumers complaint was immediately dealt with.

    Otherwise a garages reputation is not improved by having the membership.

    They can and do revoke membership of dodgy dealers.

    can u clarify

    how much was paid. what mileage has been done since purchased

    when u first noticed the problem and raised it with garage.

    i struggle with how two brake discs are cracked...

    tyres are normal wear and tear so suck that one up..

    corroded brakes line are very common, a lot of failures on the NCT... but if they where leaking from when u bought the car u would more than likely have no brake fluid after 3+ months driving on them...
    again they are consumable...

    hand brake is a worry and garage should do something based on what u say

    its a second hand car and things go wrong..thats life

    why didnt you check the car before you bought it? even if you are not a mechanic, you should have spotted if anything leaking, or if tyres are in a poor state..

    OP, that handbrake breaking off body happens on VW, Seat, Skoda. Welded one on my neighbour's '04 Seat several years back. It's a bad/weak design but proper welding fixes it for good.
