boundary ditch responsibility and ownership.

    We bought a house and built an extension with planning permission. The site has a very long garden with one side was bordered by a ditch and trees.

    We consulted with the land owner who said we could remove these trees and tidy the ditch. We did this and were left with a mound between the two areas which we intended to fix up once our build was finished. Our garden is on a slope and as a result we had to have a larger clay mound at the back, a good distance from the house. The land owner said he thought this was too high so we brought the digger back in and lowered it, no questions. However, as if under darkness the mound between our garden and his land has been replanted with fresh briary plants.

    In addition to this he has planted what we believe to be 6 ash trees, on the mound albeit on his side of the mound. One of these in particular, once fully grown will block light on two sides of our house as is directly inline with a corner of our house. He also came into what we believe to be our property to continue the planting of this thorny shrub/tree across the back mound and put one of the trees on the back mound.

    We haven't even moved into this property and hate the idea of starting boundary wars with the land owner, who by the way lives several miles away. This is just farming land.

    We consulted with him on everything. Where do we start with regards the replanted boundary ditch? Our site is on a lot lower a level also than his farmland so this ditch will seem a lot higher on our side.

    Was so excited about our first home but upset now about how he went about this, without any involvement from us.
