Private right of way costs

    Hi all

    Has anyone here had experience of getting a solicitor to register a private right of way?

    My uncle is looking to register a private right of way between his place and the main road. It looks straight forward enough once you have the consent of the landholder (shouldn't be a problem in this case) so we're thinking of doing it ourselves but if a solicitor isn't much we might just engage them to do it instead.

    I saw an old thread about it on boards where someone was quoted 7k :eek: but it was mentioned because of how high that was. I was hoping it would be closer to 2 or 3k.

    It would be unwise to attempt this without a solicitor. If it is not done correctly, access issues may not be resolved.

    People often believe that particular transactions are straightforward without having all of the information and documentation, such as title and maps.

    Also, even straightforward transactions can be made slow and laborious by certain difficult solicitors and/or their clients.

    However, leaving aside the fact that we only have partial information, I would be more inclined to shy away from a seven grand quote, if I was in your uncle's position.

    This issue differs from an ordinary house purchase/sale/mortgage, so most posters here will not be able to advise you accurately on what this should cost.

    I'd suggest that the best thing to do is to get a quote or quotes from trusted or recommended solicitors and then decide.

    Thanks Pat, I'll get a few quotes when I'm back in the country in a few weeks. I'm not a solicitor but have a bit of a planning background so its not completely out of my comfort zone. And the landholder of the land the right of way would be on is a friend of my uncle's so it shouldn't be contested by him.

    I am curious to hear from anyone else who has gone through the process. Did you think in hindsight it was something you could have done yourself?
