My car got impounded

    Hi,

I just passed a checkpoint earlier on today. I have a new insurance, thus I had forgotten to display the new disk. Unfortunately, my Tax had been out for 3-4 months too since I had not received my usual renewal letter, and that is always the reminder for me.

The garda checking my car immediately impounded my vehicle saying that I have to bring my insurance disk to the garda station and get the car taxed by tomorrow. She was saying that the I have to pay 130 euros to get my car out of impound in donabate. I had to walk home in freezing cold.

Can the car be impounded so easily? I remember being stopped before with no tax for few months and I was put on my way by a warning only. I mean its not as if I will not pay the tax, I will end up everything I owe the government

Well from the Garda's point of view, she suspected you where driving with potentially no insurance or tax. So yes the car can be taken away from you that easily.

But the guarda thinks your uninsured more for that then tax id say.

Its about 2 years since the gardai stopped turning a blind eye to road tax. The days of driving without and then getting the declaration stamped are long gone.

Once tax is out 2 months it can be impounded on the spot, insurance or not insurance. If only the tax disc had the date it expired printed on it in large font so you could see it :pac:

Yes they can impound your car if the tax is more than 2 months out of date. Tbh it seems like you are just making excuses about the insurance not being in the window or having forgot the to tax the car for 3 or 4 months.

That €130 in Donabate goes up by €35 a day. You can get a tow truck to take it out, it will need to be taxed and insured to drive it out.

You don't have tax or insurance. Hard to argue with the decision to impound it.

It's also hard to believe that you didn't know your tax expired 4 months ago.

I just passed a checkpoint earlier on today. - No you were stopped at a garda checkpoint

I have a new insurance, thus I had forgotten to display the new disk. - thus nothing, have you forgotten or have you no disk. I'd say the latter.

Unfortunately, my Tax had been out for 3-4 months too since I had not received my usual renewal letter, and that is always the reminder for me. - What's wrong with big date on tax disc in window ? This is BS

I had to walk home in freezing cold. - Correct, good

Can the car be impounded so easily? I remember being stopped before with no tax for few months and I was put on my way by a warning only. - Did you not get tax renewal form then also. You really are unlucky.

I mean its not as if I will not pay the tax, I will end up everything I owe the government[/quote] - not necessarily

Then what were you looking for? Gushes of sympathy? As the poster above said, you couldn't but have got plenty of reminders. Did you not see the tax disc occasionally when getting into or out of your car????

Is it's month or 2 months? most would yet u on and tell you to get it done asap It's pointless now not taxing it there's nothing to achieve by holding off . The op will have to back tax it also

I forgot to renew my tax, I didn't bother stick up my insurance disk. Expensive lesson learned. The Discs arnt there for the fun of it.

AGS are impounding cars which are more than 2 months out of tax.
The MTO Queen Street is open at 930 in the morning. closes at 3.30.
Your arrears are 10% of the annual cost per month due plus a minimum of 3 months current tax.
Eg. 300 per year, €30 per month arrears.

Bring all your docs to Gannon's tomorrow and get your car out. (After paying towing and storage)
Not getting a reminder is no excuse for not knowing you've not had tax for 4 months
If you previously did it online, you would have received several email reminders. If you prefer it by post just untick the box online when you're doing it next time. It's just under where you enter your email address.

What is the correct procedure when one is waiting on an insurance disc but needs to drive having full cover? I know I've put a "waiting on disc" in the holder but was never stopped.

It's 2 months so if your tax expired 11/12 (which is end November) it could be seized from 1st February onwards.

OP would be better off doing about 50 break ins, h ed would get off easier than the horrific crime of no car tax.

Probably wouldn't have to pay any compo either.

My latest insurance disk was downloaded once i renewed it, so no excuse for not placing it on the window.
But why does your tax expire at a different time to your insurance?

  • Closed Accounts Posts: 335 ✭✭HanaleiJ5N

They are well within their rights to impound it unfortunately, if someone is taking the piss with how far the tax is out (and sorry, you were kind of wandering into that territory...) it is actually quite normal for them to do so.

There can be a few reasons for that. A car could have tax on it already when buying and you can tax a car every 3/6 months instead of buying a full years tax in one go.

Depends on when car bought or tax renewed. My insurance expires in July and my tax in January - I prefer not to have two bills arrive so close to each other.

Given the time of year, and the fact insurance could well be due up on Jan 1st, the Gard would probably have saved herself quite a bit of time and effort by just giving the insurance company a quick call to check if the OP was insured. And asked them to produce tax next week.

But it's more fitting to seize the car, OP is unlikely to drive without tax out of date by months for a third time.

It's not the Gardaí's job to be checking for insurance from the companies, if they even can. Isn't that why the insurance ANPR was pulled as there's no database to check.

Also the car was impounded for no tax which means even if the Garda could have checked the insurance status they'd still have lifted the car.

Just bring the documents with you in the car. Either get them off the broker or print them off the net. I've been stopped twice like that with newly purchased cars, both times they took details of the licence asnd told me to produce insurance within 10 days.

I have a new insurance, thus I had forgotten to display the new disk.

When you say you 'have a new insurance', do you mean the policy was renewed recently - it's not a car you bought yesterday by the sound of it so where was the disc?

Anybody with half a brain driving around in a car with an tax disc that expired a few months ago would take special care to have a current insurance disc on the windscreen.

When did you last renew your motor insurance?

  • Registered Users, Registered Users 2 Posts: 8,922 ✭✭✭GM228

What is the correct procedure when one is waiting on an insurance disc but needs to drive having full cover? I know I've put a "waiting on disc" in the holder but was never stopped.

The correct procedure is to display no disc until you have the correct disc, i.e don't leave a disc for your old vehicle when changing vehicles.

Legally you are not required to display an insurance disc for the first 10 days of the policy coming into force on the vehicle.

  • Registered Users, Registered Users 2 Posts: 12,866 ✭✭✭✭bear1

So you stated in a post that you've been driving for the past 10 years and you always pay the motor tax but somehow for max 4 months you forgot?
The numbers aren't exactly small either. If a renewal doesn't come you can't take it as an excuse not to have it.
What was the expiry of the old insurance disk?
You should have offered to call the insurance company and let them confirm that you are insured to the guard.

The folks in the UK must now forget a lot, there's no disc to remind them.
