How to remove a right of way

    Hi there, just noticed on the land registry folio for our house that there is a right of way for the farmer up the road at the entrance of our house. His land is located behind the boundaries of our house. Where the map shows his right of way is where we have walls & gates into our house. He has his own access to the land via a gate further up the lane and in the 15 years we live here he has never used this and I don't believe he is even aware of this. now that we are selling I'm just wondering how to remove this right of way as I don't want it affecting sale of our house

    You can't without his agreement.

    He has a right to pass over your land so it's up to him to give it up. You can't take it off him.

    Worth talking to a solicitor, but I thought there was something that if it wasn't used in so many years, it's no longer enforceable from his part.

    Probably not too much of an issue anyway, if you explain it to any new owners they may well be fine with it.
