Used car sale, no reg cert

    Hi guys does anyone can help me.i bought this car 2 weeks ago. I am waiting for car registration for 2 weeks now.i call the guy who sold the car to me.he told me that he lost the car registraion,and he told me that he did apply already so it will take 3 weeks. That would be 1 month. Do you guys think that i can use the car?he did give a letter that he sold the car to me. I have my insurance already
    But no tax and nct.can anyone tell me whatbto do please..thanks

    You can't drive without nct so get that sorted.
    You can nct without logbook but may be asked for it and at worst they will hold cert till you produce.

    Check on motortax.ie to see if motor has changed ownership recently and tax online if so just request new pin.

    Surely would of had to sign it? Always good practice to take a photo and no reason not to.

    I do hate the level of trust with a stranger for a car transaction and registration, theres not much like it and it needs updating.

    You would be surprised the number of people who buy without even seeing a reg cert.

    If you are paying cash there can be little argument should you request that they walk to post box and post it in your presence.

    I always insist on taking the cert with me when buying a car in a private sale.

    The OP's situation happened me before and I never got the 'logbook' in the end.

    If the seller won't give me the book I simply walk away.

    Any seller giving the cert is mad.

    Its two sided to be honest.

    In op case looks like they believed the seller had it but most likely didnt.

    A buyer could do anything by not sending form off and its only to be done in the case of a dealer where another form is filled in or now done online.

    The seller is not supposed to give the buyer the cert. The buyer fills in their details on the change of ownership section and the seller posts it off to Shannon. Seller and buyer should just go to the nearest post box and just drop it in, that way there is no possibility of either being duped.

    If a pushy buyer tried to insist on taking the cert with them, then I'd politely tell them close the gate on their way out.

    I'd let you walk away. If a buyer insisted on taking it away I'd assume they were not going to bother posting it and would instead run up massive toll bills in my name.

    Seller needs to keep it and send it themselves to ensure it's done or as said, both go to post box and post it.

    Always take a copy or photo of all sides of cert.

    I have done this since I sold my 1st car at 17.

    I wouldn't bother contacting the seller anymore. A form can be got from the tax office to apply for a logbook after buying a car without a book, a garage needs to stamp it to confirm chassis number, & a solicitor/commissioner for oaths needs to sign it also.

    The seller isn't going to bother, he's duped the guy into buying the car with no cert. He's not worth pursuing, the biyer can just do it himself.

    If its a dealer its well worth going after as they can change online if genuine.

    Try getting a car back after a section 41 with no book. that is where the fun begins.

    How is it up to the seller? The form is for a person that has bought a car without logbook/never received logbook. €10 to get a solicitor to sign the form & any indy garage can sign the form, garage didn't charge me. I'm not talking about a form for applying for a lost logbook for a car already in ones name,this form also changes the ownership. I assume that's why a solicitors stamp is needed.
