ESB ACCIDENT

    I damaged a esb pole in my yard
    It was the strainer i caught with my tractor trailer
    No the esb have sent me a huge bill and a threat of court if i dont pay
    Any ideas am i liable it was on my own property
    I received no rent for said pole
    Any in put is greatly welcome

    Pay up.

    A local DIY store took down the power on our street once as a driver left the jib up on one of their trucks. Pole was located in their service yard. They had to pay for it.

    If the pole can be considered as property belonging to another person (ESB), your tractor insurers may cover the damage. However, if you've already received a bill, it sounds as if it happened some time ago and they may refuse for late notification

    What makes you think you need a contract? ESB have permission to put their property there. If you damage it you pay.

    They did at some stage. I have relatives who are farmers. When ESB was electrifying the country, they refused to allow their land to be used for poles. So the ESB had to position poles around their farm land

    I know in Dublin, you can pay and have ESB move poles from your property onto the street.

    Bill is for 7k
    I heard through for some that poles were erected through a wayleave agreement
    So not sure what liability i have to them

    What does that matter though? It was you that damaged it.

    7k though is crazy expensive. What sort of pole was it and did they break down the cost at all.

    It is your responsibility, same as if you dig up your ug service in to the house.

    It's hard to tell from the OP but with a bill like that you must have gave a rattle to a substantial line, likely 10/20kV, so your lucky the stay was all you damaged.

    Per the statement of charges from their website, most third party damage above LV is billed per the cost of repairs for that incident rather than a fixed charge; for example an LV pole replacement is about €3,500 plus VAT.
    However since we don't know what work had to be done we can only assume from the bill that a switchout was required to complete repairs on an MV line.

    I'd be paying up and thanking the lad upstairs that nothing else gave way to the trailer

    There is a pole and stay in the middle of a field of mine and its a nightmare,I said at the time that I'd rather it nearer a ditch/hedge for my machinery protection and causing obstruction in my field and the answer was thats where its going to be and that's that so the esb should be more accommodating to avoid these occurrences to likely happen

    Given that this has been repaired, invoiced and now has gotten to the stage that there is a threat of court, insurance will likely wipe their hands of it as you have a responsibility to notify them of a possible claim as soon as possible, not when you realise it will cost more than you expected and want to pass it up the line

    No, the 7k most likely covers the fact that an MV switchout was needed to replace a stay, pole or overhead cables, or probably a combination of the 3. This would have resulted in people nearby being without power for a day and if the pole was in a dangerous state this would also have been with little to no notification.

    Going by the lack of a description of the works that would be my best educated guess.

    Did the esb see it happening?

    Please say you have no idea.

    Someone i no had this happen and they just said that they weren't home they were at work and it was fixed.

    We get paid for having mast's on our property yes most on boards.ie get service.
    They are maintained but sometimes they just fall over 😞

    There is your answer.it's your private property?I've masts on mine and I've no esb bills or phone/internet/nothing the company that ownsthe polls/mast pay the bills.
