Car accident

    Hi Folks, I hope this is posted in the right place. My story is I pulled out of a garage to drive approx. 200m to turn right into a supermarket, indicator on and everything looked clear to proceed and just as I turned I hit a car that was overtaking me, my drivers wing was damaged and the front bumper totalled. He didn't look like he was stopping so I followed to get his reg and about 500m down the road he was pulled in (with lights off???) and looking at the damage to his rear bumper. I asked if everyone was OK and he asked the same, there were three in each car. He first suggested we both look after our damages to stay away from losing NCB etc. I said no way as I wasn't at fault. He tried to say I was parked on the left hand side of the road and pulled out in front of him so I rang the gardai who came "assessed" the situation and told him and me that he would be found to be at fault. The other driver agreed to pay for my damages but when I rang him with the quote it was too expensive (€1200) so being the soft kind eejit I am I said I'd look at 2nd hand parts etc. to help him out and between the garage and the two of us we reduced it to €800. When I rang him to tell him he refused to pay and said he was hoping to get it done for €500ish which is impossible, so it's now going through the insurance but when I rang his to tell them they said he had been on to them to say he had the accident and he was paying for it himself.(is that not admitting liability) His insurance asessor is coming today and my own insurance rang to say he is now claiming for his car on my policy. Plus the garda is refusing to give a written statement for some odd reason. Can anyone tell me what happens now?

    The Gardai will not provide a statement for this as it is only a minor collision with no injuries. They will confirm to your insurance company that the collision occured and the other parties details but it will come down to your insurance company and his to fight out with eachother and probably split the difference of the collision.

    I guessed that with the garda alright silverdecks, had the insurance assessor around tody so just may wait until the powers that be make their decision.

    The guard did not see it happening so is not in a position to say who is right or wrong, they take the details and it's what you pay insurance for, let them sort it.

    You did say you hit him? was your way clear and where did the cars impact?

    your front and his rear bumper , he had gone pass you ?

    Remember that the assessor for his company has his company's interests in mind. Not his. And certainly not yours. If liability has been admitted or can be demonstrated the ball is in your court, no matter what the assessor indicates. If the car isn't a write off, you can choose the repairer, and the level of repair. If the assessor doesn't immediately accept this as fact tell them never to call you again and to deal with your solicitor.

    He actually reported the accident to his insurer and told them he would be paying the damages personally :rolleyes: obviously the initial quote and the "revised" one didn't suit him so he's decidet to let the insurance take the hit.
