    Hi,

    Hopefully someone on here has an idea or some knowledge on this.

    I was in an accident 3 months ago where I was rear ended. The person behind me took liability and their insurances company paid for damage to my car. A cheque was sent in the post and I was reimbursed.

    At the time I felt fine when I got out of the car but later that evening I was pretty shook up, I felt nauseous and had a headache. I thought this was pretty standard as I was rear ended at quite a speed but I dealt with it. There were no major issues, my neck was a little sore but nothing major.

    The past 2 weeks have been a completely different story. I have trouble rotating my neck fully in the morning, it eases as the day goes on to be fair but again at night it can be quite uncomfortable. I went to my doctor for the first time today and he thinks it's from the accident and also thinks I'll need quite a bit of physiotherapy on it.

    What I'm wondering is can I claim my medical expenses against the insurance company if my claim is closed? Has anyone encountered anything like this before or will the insurance company laugh at me bringing it up months later?

    This is potentially quite serious but the only person who can help you is a solicitor at this point. Don't contact the insurance company again. Engage a solicitor to deal with this to make sure you recover your losses fully.

    As a general word of warning to people involved in accidents, insurance companies do not have your best interests in mind so dealing with them directly is a bad idea and you should always have a solicitor to deal with them so that you do not end up seriously out of pocket.
