Booking deposit

    Hi there

    We recently placed €300 as a booking deposit for the installation of a kitchen. We signed a docket that did not say that the deposit was non refundable and neither did the people working there say it was non refundable.

    We have decided not to go with this company and they are now refusing to give our deposit back. Are they within their rights?? I know booking deposits are refundable on houses

    This was not a booking but an actual order, it seems.

    I assume your contract was not just for the installation of the kitchen but included the purchase/manufacture of specific units for your layout?

    In this case the installer would have non recoverable expenses of his own and could argue that the deposit should not be returned.

    A lot will hinge around their conditions, the degree of specific work required and the time elapsed between giving them the order and cancelling it .

    Nothing was ordered for us by them. They had to come into our house to do a survey first .

    Ah, then you would have a good case, no matter what their conditions say. The kitchen units to be installed had not even been selected!
