    I hope this does not cross the line of legal advice but here goes. Friends of mine a Slovakian couple recently had a child born in Ireland (June) and had a passport application refused based on lack of Documentation proving either of their residence in Ireland for the previous 36 months.

    The mother does need meet the required period having arrived in Ireland November 2013. The Father arrived June 2013, he started work in November. I contacted the passport office on their behalf and outlined the situation.

    He lived with his Sister here during that time, I offered to provide sworn affidavits from a number of people, this was refused as they stated it was their policy not to accept affidavits, (originally the lady stated that this was in the legislation, when challenged about this she admitted she did not know).

    My question is if they have the right based in legislation (2005) to refuse affidavits and if not is my only route judicial review?
