interpretation of Class 2 of the Exempted Development Regulations.

    Class 2 of the Exempted Development Regulations states as follows
    "The provision, as part of a central heating system of a house, of a chimney, boiler house or oil storage tank"
    Has anybody got experience in the interpretation of this Class?
    I want to build a small house, about 2m2 to enclose a tank and submersible pump of my heating system. I need to locate this forward or onto the wall that includes my front door.
    To complicate matters, my gable faces the public road and the long axis or side of the house contains the front door.

    Is it a chimney, boiler house, or oil storage tank?

    If not, it's not exempted.

    You can always apply to the council for a section 5 declaration for their opinion.

    Know I can resort to Section 5 but would like to get some opinions here first as I'm sure that I'm not the first to come across this.

    It's a small house.
    Can be as small as 1.5m2.
    It will contain a storage vessel and submersible pump to pressurise the central heating system.

    It does not sound like it?

    @joebre. I don't think you will get the answer you are looking for here? Nobody will/should tell you (on here) it's 'fine' and 'off you go'.

    If it's not specifically outlined as exempt (in Class 2), then, it's not exempt.

    Either make up your own mind on it, seek professional advice, and/or take Syd's advice above and seek a Section 5 declaration.

    I think you are looking in the wrong area here for your answer, S.I. 600 of 2001 is not the only area where exemptions are mentioned, Part 1, S2, 4 of Planning and Development Act 2000 also dictates some exemptions.

    It would appear to me that 4(j) covers your requirements, but only you can say for sure.
