Changing a minor's last name

    I was wondering if I could change my daughters last name? Bit of back story, her father and I never married, he has always lived in a different country and has not seen her in two years, she will be 4 in November. He does pay child support because it is court ordered but he does not have guardianship or custody. He applied for it but failed to show up at the court. Our daughter currently has his last name only and I was wondering if it could be possible to change it to my last name. He has made it clear that she is not a concern to her [his words not mine] and he doesn't plan on visiting her any time soon.

    In Ireland a name change is legal through "common usage" so you can simply start using whatever last name you like.

    The best bet would be to start using it with the local schools, GP etc... eventually when she comes to an age where she will need a passport or whatever, the supporting documentation that has been used over the years in the new name will be used for the passport application.

    Deed poll is not necessary.

    A change of name by Deed Poll has no legal effect.

    In reality it is a mere comfort letter but there is no law in Ireland around name usage. You could call yourself whatever you want.

    Also, any change of name poll for a minor requires the fathers consent which isnt available so I wouldnt even bother.

    Start off with common usage
    When enroling in school, play school doctor etc use preferred surname on forms
    Do this ASAP to begin length of time name is used
    After this apply for passport in this name using documentation supporting use of this of this name eg school reports dentist appointments and include your own documentation as proof of origin of name.
    Then you can use passport as ID to open bank accounts and apply for drivers licence (in the future) etc in new name
