judgement order

    Hi
    Any advice on this predicament ,i will make this short, i got a claim in which i was overpaid by 20k,the insurance crowd made a mistake sending cheque to my solicitor,my solicitor sent it on to me ,a year later they come knocking looking for the 20k,my solicitor said dont contact other party and dont pay a penny,went to court and made me look like i never made any effort,now i get a judgement against me for 20k and all costs ,even my former solicitors expenses to be paid,not a hope in hell.!!

    Not particularly helpful, but did you really think that ignoring it would make it go away, despite your solicitor's advice.

    You need a new one, quickly. And sell whatever is that you bought out of the 20k.

    What assets have you got that they are going to enforce the judgment on ?
    If you have no assets they are going to rely on you to come up with a repayment plan that you can afford , unless you have the cash to hand .

    And what are you expecting from this? You have to pay the 20k back, obviously. It wasn't yours to spend. Did you not notice it when. You got it?

    I was advised to ignore it and not to worry! . i was willing to pay this when it came to light but now its 2 years down the line,solicitor has made me look like i made no effort and she keeps her good name,no assets,4 kids ,morgage,1 income.im thinking new solicitor and let them
    all f off.

    Well then go to another solicitor in a different area. Then contact the law society. I hope you kept all letters from solicitor to you. While you will have to pay 20k the interest costs etc may be worth fighting about. It's one thing to ignore letters it's a whole different matter to ignore proceedings.

    I assume the judgement will be registered on your house, but if there is already a mortgage on it then that gets first priority

    yep ,ive no problem paying the 20k but i dont think me paying for her costs for her miskakes is fair ,i think a solicitor in a differant area is a good idea as she got current solicitor to represent me and they friends..

    What do you mean by current solicitor?

    Solicitor that she picked to represent me in court as a favour to her.he sent me out judgement order.I relied on her without thinking .
