Applicant to An Bord Pleanala for review of retention refusal has died

    Someone in our housing estate built a substantial illegal extenstion that was later reported to planning enforcement. They subsequently applied for retention permission that was refused by the county council. An appeal was then lodged with ABP and is due for hearing in August.
    The property owner died last month and we understand that the property may transfer to his children. While I don't mean this as a disrespect to the recently deceased owner / ABP applicant, but what will happen to this process now? Assuming the property does transfer to next of kin, do the planning obligations?

    Yes. If ABP allow them to keep the shed then that's it sorted.
    If they refuse it, Plan Enf will have to chase it again, possibly from the start as the name on the notice will have to be amended.

    It's also worth noting that if they try sell the property, the purchasing solicitor will do a search and it should highlight the Enforcment on the property and stop a sale going through until regularised.
