Solicitor's financial memo not very diligent

    Hi,
    Moving house very soon. Been asking solicitor to give me exact figure we need to transfer to his account to close off the balance. Want to avoid inter-day bank transfer charge but looking like it's unavoidable now.
    Now the main point. He sent me financial memo today. Some errors were obvious to me anyway. More worryingly there were also not so obvious errors that we could have missed e.g. A couple of months ago we transferred 5k to his account and then subsequently the full contract deposit as he wanted it in one lump. We told him of the extra 5k at the time. Now this 5k is not mentioned anywhere in the memo.
    Is there any point in asking him to reconsider his total fee? I could go on, but I won't. For the last few months I've tried to avoid this situation, I was going to redeem the mortgage, but he said he would. Now he doesn't even know the amount.

    Just go back and say that you've noticed some items aren't accounted for, and can he / she check their bank records. You would be surprised how many banks put a non desript reference on a lodgement.

    Why would they change fee?

    No I've done out a revised Financial Memo with corrections and proof of payment. I told him at the time and due diligence would have him check his bank account while doing Financial memo.
    At times he hasn't flagged things to us at the appropriate time, causing me hassle around work, having to go bank when under pressure at work. I know moving house is pressure but he hasn't helped.
    I don't expect or care about the fee but if some professions this sloppiness would have some ramifications

    Was meant to close today on the sale.
    Will not be until early next week now as solicitor hadn't sent everything. Worse still he said they were waiting on me.

    Now existing bank are ringing me saying credit rating will be impacted.
    He received a letter from Bank a week ago and still it hasn't been redeemed.

    Is this standard fare from a solicitor?
    They should shield us from all of this or why do we pay them?

    If he is supposed to clear the mortgage out of proceeds of sale, the sale will have to close first, before the mortgage can be paid off.

    If there is a delay in closing and if your bank is contacting you about payment of the mortgage, you should contact your solicitor and let him know that you are being put under pressure.
