South African Citizen married to UK citizen - Relocating to Ireland

    Hi Everyone,

    [font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif]I am a South African Citizen and my husband is a British citizen. [/font][font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif]We are looking at relocating to Ireland.[/font][font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif] [/font]

    [font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif]I would like to know if anyone can help me answer the below questions as we are not entirely too sure of the processes involved. [/font]

    [font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif]1. As a South African citizen, I know that I do not need a visa to enter Ireland. Will I be able to work immediately (while I apply for the residence card) hoping that my husband will be working and exercising his EU treaty rights?[/font]

    [font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif]2. A few sources have stated that the residence card can take up to 6 months to process, while South Africans are only allowed in the country for a maximum of 3 months without a visa. What should I do to ensure that I may remain in the country for the duration of this application? [/font]

    [font=verdana, geneva, lucida, "lucida grande", arial, helvetica, sans-serif]3. Once the residence card has been issued, does that allow myself (South African) free movement within the EU? [/font]

    You will only be able to work once the permission is granted, a temporary permission should be granted pending the full decision. The temp permission of needed will bridge you past 3 months.

    In theory you should be able to travel through out the EU but be aware some states don't really understand that, and the right is in my opinion when travelling with spouse or joining spouse.

    1. In theory you can work straight away. In practice you will only be able to once your husband has found employment, you have found a common residence, and you have submitted you residence card application and received an acknowledgement of your application which allows you to get a temporary residence card while the decision is pending.

    2. As long as you submit you application you will be fine even if the final decision takes 6 months (a temporary residence card will be issued while the decision is pending)

    3. The final residence card (not the initial temporary one) will allow free movement for leisure purposes as long as you are traveling with your husband and the stay is shorter than 3 months. It will not allow you to reside and work in another country or to travel alone.
