Dealing with PIAB v Direct Insurance Company

    Hi,

    My son was involved in an accident a few months back which was the fault of another driver. In fact the other driver was on a provisional licence, without L-plates displayed and without a qualified driver in the car with him. His insurance has already paid out on the replacement of my son's vehicle so effectively assuming responsibility.

    My son has a back injury which seems to be healing now following physio. The insurance company has given us the option:

    1. Dealing with them directly regarding reimbursment for the injury and costs. Basically they would make an offer that we could accept or decline(decline and then go to option 2).

    or

    2. Going through PIAB/injuries board who would make an assessment and recommendation on what the reimbursement would be.

    I was wondering if anyone had experience in either of those two options. I've been led to believe that dealing directly with the insurance company might be quicker but would their offer be a fair one? Would I be wasting my time?

    Any help or advice on this would be greatly appreciated. Thanks

    What does he need the money for and how much does he need? The PIAB settlements are fixed amounts depending on the injury.

    As Mr. Ingognito has said, speak to a solicitor, as legal advice is not allowed.

    That said, unfortunately my own experience in similar situations is that the insurance company will often cover property damage when it seems that they are liable, but this is not an admission of liability. An insurance company is always going to try to pay as little as possible. What is most important, is that your son is fit and healthy and I would not personally do anything without proper legal advice. I have gone through the PIAB and yes, it can be longer, but an assurance of full recovery can also take a while. Consider health before wealth.

    PS - Provisional Licenses do not exist. They have been replaced by learner permits.

    Bear in mind the insurance company offer is just that, an initial offer and they will start low. This will be a negotiation and you should counter with your highest amount with the hope that eventually you will end up somewhere in the middle with an amount you both are happy with. If of course you take that route.

    If you are no good at that stuff yourself get someone to negotiate on your behalf, either a professional (who you will have to pay at your cost, not the insurance company) or someone who is just good at that sort of negotiating.
