    Hi there, I'm wondering how to go about compensation for my son who got injured at a monument. He fractured his thumb and we have been to hospital 3 times so far. The monument wasn't fenced off. I found the company who own that land/monument. Am I entitled to compensation? How much can I ask for? Do I need to contact a solicitor before asking them for compensation? I really don't want any hassle so I was thinking to just ask them for 1000 EUR and want to wait and see about their response. What do people think? My son is 3 years of age. Thanks in advance.

    Could you not chalk it down to personal responsibility as you should make sure your child in you're care is watched at all times.

    How can you claim for an accident as such unless it was a dangerous object or hole uncovered and so on.

    I was there when it happened. It was a part of an iron cast anchor that I didn't know was able to be manipulated.

    I don't see how or why you would or could claim.

    It's your responsibility to make sure things are safe and if not sure keep child away.

    Why do you want money?

    Not just ask them to pay the medical bills?

    Have you proof it happened as company not going to give you money without proof

    yes i suppose. well my son can testify. the bills are not that much at the moment but it was a lot of hassle, time etc. running around, waiting in hospitals etc.

    Why would it be fenced off? Do all our monuments now have to be fenced off?

    This kind of greed will eventually lead to fewer monuments being available to the public. Your child's safety is your responsibility, not that of a landowner or council. Stop trying to pass the buck.

    And your son can not "testify" if he's 3 years of age.

    i could have not prevented it. i thought the monument was secured with no moveable parts.

    Monuments are not for climbing on

    You could teach your child they shouldn't climb on monuments, or you could take more care and ensure their safety.

    If they had fell off the monument and broke their arm would you still want to claim?

    The child shouldn't have been climbing on it in the first place and that's your fault for not keeping a close enough eye on him/her.

    It's the parents job to keep them safe as a child will try to do many dangerous/stupid things and don't know any better, but if you had have told your child not to climb the monument then this wouldn't have happened.

    Do you let your 3 year old wander in to any area without first checking it is safe for him? Hopefully there never comes a day where you wish you could have your child back, rather than wonder how much he could earn you in compensation

    the monument was not fenced off. have you got kids emmetkenny? these things happen in a split second. a fractured thumb or broken arm. what difference does it make?

    If any compensation is agreed it must be ruled by a Judge and all compensation lodged to the Courts accounts I I'll your son turns 18.
