Garda and abandoned house used for drugging

    liveline had a story about an abandoned house used for drug taking. used needles and tablets left around. children had access

    I just wondered would the garda not have the power to remove the tablets and or watch the house and raid during a session?

    Apparently now they are boarding at first they could not go in -where illegal drugs were -because it is a private house?

    This is just a curiosity nothing to do with me

    I had the same issue with the house next door. Its just 2 houses together, not in an estate. They were freely coming and going through the front door. The Gardai couldnt (or wouldnt ) do much so we evicted them and boarded up the house. That was about 3 years ago now.

    Not correct to go into a property they will need a warrant.

    If that were the case, are warrants only for houses where they dont know if there are drugs there or not?

    it was actually me who was on live line and no the Garda nor town council would remove needles or board it up because its private owned house even though she has washed her hands of place! and yes its been boarded up but by a local bulider who knock at my door and said he was willing to board it up to protect kids in area

    How can the builder board it without her permission when its private owned house?

    With nails and a hammer, I'd imagine

    If the owner doesn't care about junkies living in their property, it's unlikely they'll care about someone putting up a few boards.

    Not correct to go into a property they will need a warrant.

    So if someone is screaming rape/murder from a house and a Garda is walking by they cannot enter the house ?

    Or if door/window to a house is wide open and a Garda can clearly see a crime in progress they cannot enter ?

    I was responding to a clear statement, here it is again "I don't think the need a warrant if they know there are drugs there." I answered to that statement that a warrant would be required. If AGS are of the opinion that evidence could be destroyed then they may be found to have lawfully entered, as with if they believe there is immediate risk to person or property. Of course it may be later determined that the search was unlawful, depending on the facts that decision may (remember i say may) lead to the evidence been excluded.

    Is it a illegal to board up an abandoned house? We have one in our estate that is causing a lot anti social behavior. If I board it up, what legal implications could there be.
