Draft declaration of identity furnished with the title?

    If you are selling a property, how do you go about getting hold of a signed declaration of identity with the booklet of title? A draft one exists but a copy of the signed one is required. I think it's the person who signed off on the complex who it's in relation to? Would the local authority have it? Or where could it be got? Thanks

    Declarations of identity are not always absolutely essential so if a seller doesn't have one then he will often simply refuse to get one for the purchaser.

    If the purchaser insists on receiving a declaration of identity and if the vendor doesn't have one to give, then the vendor might get one drawn up by an engineer/architect.

    However, a seller may not have an engineer/architect and it may be more likely that a purchaser will, in which case, the least inconvenient approach may involve the purchaser getting his own architect/engineer to draw it up.

    As regards hunting around for lost deeds, it's much easier to get a solicitor to do it as they are used to that sort of thing and they should know where to look.

    EDIT: If there was a draft declaration of identity with your original deeds but no actual sworn declaration, the question may arise as to why that is the case. Maybe ask your solicitor.
