Car falsely advertised

    Hi again,

    Not sure what I can do this one.

    I got a second hand car from a dealer the other day. When I looked it up on the internet it said it was a 1.4 and when I arrived to look at it he said it was a 1.4.

    So all was good and i went back the next day to collect the car and he said "oh yeah that's a 2.0ltr"

    Is it my fault for not checking the tax disc for the amount and knowing it was a 2.0 or his fault for false advertising ?

    I took the car on the day as I thought I must have made a mistake but I looked and the saved the advert and it does say 1.4.

    What do you think I can do?

    Does it being 2.0 litre instead of 1.4 litre mean you would not have bought it?

    While the garage were at fault for incorrectly advertising it there is imo still some onus on a the buyer to do some background checks on the car to make sure that no surprises like this pop up and you were happy with what you were buying.

    Not sure what you can do now that you have bought it being honest. Harder now to get a result that you took it after he told you it was 2.0 litre. Have you spoken to the garage about it?

    Hardly now! If a professional tells you that the car is a 1.4 litre then it that case it should be a 1.4 litre and not a 2.0 litre.

    Clearly the dealership knew it was a 2.0 from the start otherwise they couldn't be in business with such lack of knowledge. The only reason they advertised it as a 1.4 is probably because most buyers don't want a 2.0 (assuming it's a petrol).

    Yup it is a petrol.

    There is no way i would have got it if it was advertised as a 2.0ltr not in a million years.

    But I thought as I didn't check it I would have no come back.

    Why did you proceed with buying the car after he told you it was a 2lt. Had you already paid in full and signed all the paperwork?

    What car is it? I'm thinking the likes of a golf, focus or an astra?

    Anyway I'd say if you push it and provide proof of the ad you might get somewhere. Say you can't get insurance or something and its completely worthless. I looked at a car a few months back and the sales guy hadn't a clue about it, not one clue about engine size etc...

    Folk that.
    Get down there in person with the car. Don't bother dealing with the salesperson you were already on to. Get his/her supervisor. Demand a refund.

    At what stage did he say 'oh yeah that's a 2 litre' had you already signed and paid up. Why did you not say anything then I'm confused

    Is there any engine size stated on the order form?

    I wouldn't rely solely on the advert.

    I would go with: car advertised as 1.4, salesman repeatedly referred to car as 1.4 in person.mbought on basis of being 1.4, car paid for and mistake only casually mentioned upon collection, salesman didn't give you your options at that point, ie cancel the deal or continue. You felt pressured to continue as the mistake wasn't admitted. Print out copy of advert and show.
    You are now cancelling, as you should have at time of collection as the salesman didn't act professionally, and explain the implications the larger engine (say much higher insurance, or tax)

    What happened when you called your insurer to switch over cover, did they not tell you that it was a 2 litre when you gave them the reg?

    Not to demean you in anyway but if you weren't brave enough to suddenly say "hold on a second" at that moment and cancel the sale I think you would be best to have someone a little more brazen to go with you when you go back or they'll walk all over you.

    and i say this as someone who wouldn't be the most confrontational either.

    Do a history check on whatever your buying next too, can throw up all sorts of info, well worth the money.
