NO EU Spouse of Irish working in UK

    I know the Schengen agreement is applicable to other EU states coming here. there non eu spouse can come here and stamp 4 FAM to work here.

    My question is does anyone know if a non eu person marries an irish person they get a stamp 4 to remain here with their their irish spouse, however if the irish person was to move to th euk could they take the non-eu spouse with them thats on the stamp 4 to uk to work and live also. Does Ireland have an agreement with the eu or with the UK that this can be done???

    this boards is great, so maybe someone has experience of this where they married a south american and maybe mved to the uk for work and was able to bring their non eu spouse because of their stamp 4 resisndence status in ireland.

    Anyone know??

    You can take along your spouse but you need a respective visa for them from the UK or the individual EU country you move to. Ireland is not Schengen else this would have been much smoother witin Schengen countries for such situations.

    If I understand your question correctly - you are asking if you can move without a fresh visa from the UK? Take it, for example, if your spouse went home for vacation in Latin America and is checked for a UK spouse visa at the airport on the way back (as airlines all need to do else they are liable for the deportation costs) but only has an Irish visa...that would not work. Stamp 4 is issued by Ireland and only covers Ireland for your spouse in terms of residence and work permit.

    On a similar note - For example, I am an EU citizen married to a Non EU citizen and my country which is EU and Schengen does not care one bit that my spouse has a Stamp 4 EU Fam as that is an "Irish visa" to them. If we want to move to my country they'd consider the application independent of us being in Ireland; we could be outside of Europe and it would be the same paperwork.

Whenever my better half wants to go on a business or leisure trip without me he needs a regular visa like any non EU citizen not married to an EU one.

    They get residence to be "with us" so European governments seem to take that quite literally. Our access to free travel does not apply to them at all.

    He IA from a non visa required country do can travel no problem abs has his gnib coming back on.

    But I thought maybe as he has residency for here as a spouse would be allowed in on thay basis. Special spouse visa something

    Watch out for the UK referendum mid June as this will also impact visa regulations for EU citizens and their spouses if it's Brexit after all. You might get stuck in the middle if you don't move quickly.
