Letter of Working Notice = Redundancy?

    Hi,

    I've just been informed that my services are no longer required. They're sending me a "Letter of Working Notice".

    My employers are Canadian and I'm not sure they are aware of Irish law when it comes to terminations/redundancies. The content of the letter is below. Am I entitled to statutory redundancy?

    After careful consideration, "Company" has determined that we are no longer able to support your employment due to changing business needs. "Company" will provide you with 10.5 weeks working notice from today, Monday May 2, 2016, to the date your employment will be terminated on Wednesday July 13 2016. In the event that you wish to terminate your employment with "Company" prior to Wednesday July 13, 2016, entitlement to notice shall be null and void.

    During this period of working notice, we expect you may be required to be available for potential interviews or discussions, but you will be required to continue to carry out the duties and responsibilities of your position within the company.

    End of Employment
    If you should resign or locate alternate employment at any time prior to the expiry of the working notice period, "Company" will cease to pay your salary and benefits immediately. The following will occur at the end of your employment:
    Compensation & Holiday Pay - all monies owed to you, inclusive of salary and holiday pay, will be direct deposited following normal payroll processing dates.
    Health and Dental Benefits - Your current coverage will end on July 13 2016.
    P45 - "Company" will provide a P45 form after the date you receive your final pay.

    An update.

    My Statement of Employment Terms says:
    "In the case of dismissal or termination of employment, the Employee or Employer agree that the Employee will be provided 2 weeks' notice per year of service or an equivalent amount in pay in lieu of such notice in full satisfaction of any notice requirements".

    The work is project based. I was working for a number of years on a project, the work dried up and I was moved to another project. A couple of months after starting that project, my employer asked me to fill in for a maternity cover for a year on a different project and I agreed. That girl returns at the end of June. So, they are arguing that because the job has not gone away, it's not a redundancy situation and they revert to the terms of my contract.

    I don't have a leg to stand on, do I?
