Property Management company removed my car

    The property management company removed my car from the underneath parking because they said it was abandoned.

    The car was untaxed and with no insurance because its been a while since I dont use it, but it was parked correctly. They first asked me to pay a tow truck but then they started to not picking-up the phone or not returning my calls.

    I called the Garda for help and they said this is not their business and suggested me to engage a solicitor, I dont know how much it would cost me and I feel terrible to have to end up like this.

    The car value is around 4,000 euro on the second hand market.

    Did you own the parking space? An untaxed car on another persons parking space may as well be litter.

    In what way was this car possibly abandoned?

    You knew where it was, your frequency of use was irrelevant, Your a resident i assume and legally/contractually allowed to park in a spot?

    Since they contacted you, it was obvious you had not abandoned it.

    I would write a registered letter to them, keep copies, and query their decision.

    You didnt have a second car you were using and thus using two spaces whilst only paying for one?

    The car was on an unassigned parking space, but not a parking space from another neighbor: The parking is big and most of the spaces are unassigned, most of the neighbors prefer to park in the street. I left the car in the parking because it has a flat tire.

    I contacted them the same day I saw the car was not there. I didn't refuse to pay for the tow truck to get my car returned! but still no call back from them, now I'm starting to be worried about my car.

    if your car was stolen then charge them
    With theft.

    There is a difference between unassigned and you being able to park there.

    You need to check the lease to see what it says about parking but every lease I have ever seen specifically mentions only parking in YOUR assigned space(s). Generally speaking, even if the car-park is 95% empty, you have no right to park in any other spaces. Only if you know that you have the right to park in that space could the guards do anything re. theft etc.

    To be honest, engaging a solicitor will probably end up costing you more money than just paying the towing fee unless you have a cast iron case against the management company :(

    Insist to properly management company that it's theft and that you will going to the guards if it's not returned immediately

    And tell the guards it's criminal theft and that's it.

    I'm not refusing to pay the towing fees.

    Since I said I will they are returning my calls nor contacting me back in any way :-(

    If you want the car back, then your only option is to instruct a solicitor at this point.

    It should not cost a huge amount to get the ball rolling with an issue such as this.

    Assuming the car is still around for return, and hasn't been scrapped/crushed already.

    Many of these car towing companies don't hang on to them long, unless they are worth something.

    If the car has been destroyed, then all the more reason to get in touch with a solicitor.

    Do own the apartment or are you a renter? If a renter, perhaps the Management Company had been in contact with the landord?
    You say it was an unassigned space, are there house rules on how long you may occupy one. Where I live it is 48 hours.

    In my complex for any "abandoned" vehicles a letter is sent to all units saying x vehicle will be removed in a few weeks. They can't just hire a tow wagon a lot of paper work has to be done to remove vehicles which are trespassing on private property.
