Advice needed - Property Conveyance

    Hi

    My wife's mother died over a year ago and her house is only now about to be sold due to subsidence work under her insurance being resolved. All is complete now and my wife and have agreed a price to buy it from the other siblings. All is good on that score. Even better, we are in a position to buy the house without a need for a mortgage. Her elder sister is the executor and is game ball for this to go ahead asap. However the family solicitor says conveyancing could take 6 months and has asked a number of times if we were getting a loan. We have the money in an account ready to go. Is this odd by the solicitor ? Also do we have to go to our solicitor or should we shop around ?

    Do you mean the one solicitor is selling on behalf of the estate and buying on your behalf? If so you not only should but if I remember have to get your own solicitor.

    The same solicitor cannot act for both vendor and purchaser. Get your own solicitor pronto and do not get one recommended by the current solicitor.

    Sorry no, the solicitor is different for us, but the executors solicitor is saying it could take 6 months. I would have thought it is a very simple piece of work. The freehold has also been sorted.

    Has as the Grant of Probate been extracted, in the mother's estate? Maybe that is the reason for the anticipated delay? You need to get your own solicitor anyway, so you will be able to ask him/her to explain the situation.
